PoSH Act 2013

Under The Ministry of Women & Child Development, Sexual Harassment of Women at the Workplace (Prevention, Prohibition and Redressal) Act, 2013 is a law to prevent and to provide protection against, Sexual Harassment of women at the workplace as well as redressal of complaints of Sexual Harassment. The Act covers any / every place visited by the employee during the course of employment including transportation provided by the employer. Even non-traditional workplaces which involve telecommuting, virtual spaces etc are covered under the Law.

It is MANDATORY for every establishment; commercial or non-commercial, engaging more than 10 people at a premises; including regular staff, personnel engaged through outsourcing etc to comply with the provisions in PoSH Act 2013.

Non-compliance of this law shall attract penalties up to Rs. 100,000 and cancellation of license to carry on the activity.

PoSH Compliance Requirement

Every establishment with 10 + working (including staff, personnel engaged through outsourcing) in premises should:

  • 1. Form PoSH policy.
  • 2. Sensitize all employees (including personnel engaged through contracts) regarding PoSH Act 2013.
  • 3. Form 5 members Internal Complaints Committee (ICC) comprising of at least 2 employees on premises, 1 external member and a female presiding officer.
  • 4. ICC members should be trained for PoSH and handling grievances.
  • 5. Display PoSH policy with ICC at conspicuous place in the premises.
  • PoSH Act 2013 should not be implemented just for Compliance;

    A comprehensive report with feedback / suggestions / recommendations based on reviews and debates to be sent to Ministry of Social Justice; Ministry of HRD & Education; and other relevant functionaries in all States. The report will also be shared on social media. The report will include

    • 1. List mentioning participating organizations, institutes etc
    • 2. Best thoughts and contributors of best thoughts
    • 3. Special write ups from top teams
    • 4. Special write ups from Institutes involved as ‘Hosts’
    • 5. Special write ups from district level winners onward

    PoSH Implementation in Spirit

    Harassment at workplace not only make the establishment vulnerable toward reputation and goodwill; but also leads to low job satisfaction, productivity, loss of valuable employees and declining workplace culture. Implementation in spirit will benefit the establishment in more ways than compliance. We recommend you;

  • 1. Select and engage ICC members for 3 hrs training session.
  • 2. Keep ICC members easily accessible to employees.
  • 3. Keep quarterly ICC interactive sessions with employees.
  • 4. Have an active presiding officer; or active external member in ICC.
  • 5. Display PoSH Compliance Certificate with updated ICC details.

    Responding to the Government of India; ABCDE Foundation conducts surveys in view of spreading awareness about PoSH Act 2013. Though this law has been enforced in 2013, many establishments and employees are unaware of the provisions in it. It has also been noticed that many establishments are compliant on paper; however unfortunately not so in the spirit of purpose of PoSH Act 2013.

    1. What topics will be debated in National Social Debates Forum?

  • A: Different topics of social and National importance shall be selected for each series of debates.
  • 2. Do I have to engage in debates on Twitter to qualify for face-to-face debates?

  • A: Responding to questions posted on Twitter will give us an idea of your position on the topic, which will help us form groups for face-to-face debates. Secondly, one of the purposes of NSDF is to spread awareness about the chosen topic, with unbiased opinions of educated people from different walks of life.
  • 3. Do I qualify for all face-to-face debates if I get involved on Twitter debate?

  • A: Not necessarily, one of the purpose to start with Twitter debate is to identify competent participants. Your responses on Twitter debate will prove your knowledge and competence to debate face-to-face on the topic.
  • 4. Who judge and on what parameters?

  • A: Different people will go through responses and give a rating on a scale of 10. Basic Parameters are:
    • 1. Are responses logical?
    • 2. Are responses expressed with own words, or just compilation of quotes of others?
  • 5. How will I know if I am selected for face-to-face debates?

  • A: Through Email / WhatsApp and shall be posted on Twitter as well. It is advisable to regularly check this website; and our Facebook and Twitter pages.
  • 6. Will you be making travel and stay arrangements if I get invited for the debates at other centers / Zonal or National Finale?

  • A: For most debates travel and stay arrangements only for Finale shall be done from our side; however it will be decided from debate to debate.
  • 7. Will the debates be covered by any channel?

  • A: We shall invite many news channels to cover the debates, however are unsure of full coverage / programming. Our edited programs shall be sent to news channels for their news reports. The debates shall be made live on multiple social media platforms by multiple users. Participants or audience may also record / telecast live on social media.
